Driving Rights Restored!

After an initial – and ridiculous – denial of my client’s appeal to have his driving privileges restored, I successfully appealed the matter to the Genesee Circuit Court where the lower ruling was reversed and the judge signed an order reinstating my client’s right to drive.

Originally, my client’s driving privileges were revoked after he received multiple OWI convictions in the early 2000’s. He then went without his license for over a decade, then he called Chris Kessel Law. We filed the application for a hearing along with the necessary letters of support and additional documentation. After that, we had a hearing, during which the hearing officer admitted that he believed by client had been sober for the necessary period of time…then he denied our appeal…WHAT?!

To say I was shocked was an understatement. My clients asked what we could do, and I told him we should appeal the matter to the circuit court. We did and a hearing was set before Judge Behm, who agree with my argument that the denied was “arbitrary and capricious” (which is legal for “bullshit”) and reversed the ruling and granted my client his right to drive.
